Terms & Conditions:
1. Entry into this competition is deemed acceptance of these and any other applicable terms and conditions. This competition may have additional terms and conditions and wherever possible the additional terms and conditions will be posted at www.foursquare.co.nz.
Promoter
2. The Promoter of this competition is Foodstuffs North Island Limited (Foodstuffs).
Promotion Period
3. The competition consists of two separate prize draws and promotion periods. The first prize draw commences on 16/9/2024 and runs until close of trade 13/10/2024 (First Promotion Period). The second prize draw commences on 14/10/2024 and runs until close of trade 10/11/2024 (Second Promotion Period).
Eligible Spend
4. You will receive one entry in the draw for every $50 or more you spend in one transaction (excluding spend on gift cards, prepaid debit cards, travel card top ups, phone card top ups, tobacco products, rug doctor products, account payments, New Zealand Lotteries tickets and purchases paid for through charge accounts or purchases intended for wholesale or resale) during the First Promotion Period and/or Second Promotion Period (Eligible Purchase) at a Four Square grocery store in the North Island (Participating Stores). Purchases made from a Four Square grocery store in the South Island are not eligible.
5. When you make an Eligible Purchase, you will be asked to provide your contact details. You must provide all requested information on your receipt and place it in the entry box at checkouts to go into the draw.
6. To avoid doubt, you will only receive one entry into the draw even if you spend more than $50 on qualifying products in a single transaction.
Eligibility to enter and to win a prize
7. To be eligible to enter this competition and win a prize:
1. you cannot be a Participating Store or Foodstuffs staff member;
2. you must have made an Eligible Purchase from a Participating Store;
3. you must be 18 years of age or older;
4. you must consent to Foodstuffs using your name, photo, hometown and image for publicity and promotional purposes (including the display of your name in store) and you must make yourself available for publicity photographs relating to the competition on request for no additional compensation.
Prizes and how winners will be selected
8. There will be two prize draws and there are two prizes to be won in total.
a. The first prize draw will be drawn by Foodstuffs (or its agent) by 14/10/2024 by random electronic selection from all Eligible Purchases made during the First Promotion Period. The first eligible entry drawn will win one 60-second ‘Grocery Grab’ a Participating Store, valued at a maximum of $350 (including GST).
b. The second prize draw will be drawn by Foodstuffs (or its agent) by 11/11/2024 by random electronic selection from all Eligible Purchases made during the Second Promotion Period. The first eligible entry drawn will win one 60-second ‘Grocery Grab’ at a Participating Store, valued at a maximum of $350 (including GST).
9. Each ‘grocery-grab’ will take place at a Participating Store determined by Foodstuffs. Each winner will begin the ‘Grocery-grab’ from a designated starting point, and the winner will have 60 seconds to select eligible products from the store up to the maximum value of $350 (including GST) (subject to clause 11) using one hand at a time. Only one person can partake in the ‘Grocery-grab’ prize.
10. For the avoidance of doubt, alcohol, tobacco, gift cards, prepaid debit cards, travel card top ups, phone card top ups, New Zealand Lotteries tickets and select high value items as advised by Foodstuffs and/or the Participating Store are prohibited from being won as part of the ‘Grocery-grab’. If a prize winner selects products that are not eligible as part of the ‘Grocery-grab’ the winner will not be permitted to keep these products, and they will not contribute toward the total prize value.
11. If a winner grabs more than $350 worth of goods, they will be required to either pay the difference or return items of their choosing until the total value of the ‘Grocery-grab’ is equal to or less than the maximum 350 (including GST) prize value. If the winner grabs less than $350 worth of groceries by the end of the 60 second period, any remaining balance will be forfeited.
If prize becomes unavailable
12. Subject to any applicable law that cannot be excluded, Foodstuffs is not responsible or liable for any loss suffered by any entrant in the event that a prize becomes unavailable for reasons beyond its control. In this event, Foodstuffs may substitute a prize of its choice.
Notifying winners
13. Winner(s) will be notified by Foodstuffs or its agent within 5 working days of the draw being completed to arrange a time for the prize to be collected, via the contact details provided when entering the competition. In the event that a winner cannot be contacted within 7 working days of a draw occurring or if Foodstuffs determines that a winner is not eligible to participate in a draw, the prize will be forfeited, a further draw will be conducted and the prize allocated to the new winner.
14. Foodstuffs is not responsible if a winner cannot be contacted following the draw due to incorrect or out of date contact details being provided, and any such winner will forfeit the prize to the next eligible winner, on these Terms and Conditions.
Prize conditions
15. The prize winner and Foodstuffs will work together in good faith to mutually agree a time to complete the ‘Grocery-grab’ outside of the Participating Store’s trading hours, however, the time of the ‘Grocery-grab’ shall ultimately be decided at the sole discretion of Foodstuffs. If a prize winner is unable to make the time, or does not show up, a further draw may be conducted, and the prize allocated to a new winner.
16. Winner must comply with all of Foodstuffs and the Participating Store’s health & safety policies and instructions when entering the premises and completing the Grocery-grab.
17. Prizes are not transferable, exchangeable or negotiable and are not redeemable for cash.
Verifying compliance with these terms
18. Foodstuffs reserves the right to verify the identity of any entrant (including an entrant's identity, age, city/town of residence and place of employment) and to verify the validity of entries and to disqualify any entry or refuse to award a prize where false or misleading details have been given by an entrant, or an entrant has behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these Terms and Conditions.
Exclusion of liability
19. Subject to any applicable laws which cannot be excluded, Participating Stores, Foodstuffs and their respective employees and agents will not be liable for any loss, damage or injury of any nature incurred or suffered by any person (including but not limited to direct or consequential loss or loss arising from negligence) arising directly or indirectly out of or in connection with this competition or with winning, redeeming or benefiting from the prize.
Disputes
20. In the event of a dispute concerning any aspect of the competition including eligibility the decision of Foodstuffs will be final. No correspondence concerning any decision made by Foodstuffs will be entered into.
Additional terms
21. Foodstuffs reserves the right to amend, suspend or terminate the competition and these Terms and Conditions at any time.
Privacy
22. All entries remain the property of Foodstuffs. Your personal information may be used to conduct this competition and for future promotional and publicity purposes in relation to this competition. By entering this competition, you consent to the use of your personal information for these purposes. Foodstuffs’ Four Square Privacy Policy will apply to all personal information that we collect from you.
